CarpooltoSchool Privacy Policy

CarpooltoSchool, LLC (“CarpooltoSchool”, “we”, “us”, or “our”) respects our users’ privacy. We understand that you have put your trust in us to ensure that your family’s information is kept confidential and secure. The purpose of this privacy statement is to inform you what personal information we may collect from you, how we use such information, the choices you have regarding our use of the information and your ability to review and correct your information. As you know, our primary purpose in collecting information from you is so that CarpooltoSchool can assist you with carpool matching and carpool arrangements. We also collect information from you to improve your experience and to communicate with you about our services and updates to those services. We do not sell or rent your personal information, including your name, address, e-mail address or contact information, to third parties, except as disclosed in this Privacy Statement.

By using any of our [Services], you agree that your information, including personal information, will be handled as described in this Privacy Statement. Your use of our [Services], and any dispute over privacy, is subject to this Privacy Statement and our Terms of Use, including its applicable limitations on damages and the resolution of disputes. If you do not agree with any provisions this Privacy Statement, as drafted now or amended in the future, you should not use our [Services].

We reserve the right to change this Privacy Statement at any time. If our Privacy Statement changes, we will post the revised Privacy Statement on our website. If we make material changes, we will take steps to notify users, such as through a notice on our website or via email. Please refer to the date at the bottom of the Privacy Statement for the effective date. Information we collect directly from you: We collect information about you when you sign-up for CarpooltoSchool, including your: name, address, email address, telephone number, work number, cell phone number, cell phone carrier, emergency contact information, gender, child(ren)’s name, gender, date of birth and special instructions relating to your child as specified by you. We will also collect any other information that you provide to us through our [Services], such as your name, email address, and the contents of any message that you submit through our website.

Information we collect from third parties: We also collect about children from their parents or legal guardians, such as the name, dates, description, times and location of child(ren)’s activities. We also request your child(ren)’s coach’s name and contact information. It is your choice as to whether you would like to provide your information to us. You will still be able to view most of our website and Mobile App pages even if you choose not to provide information about yourself and/or family members. However, please be aware that if you choose not to provide the requested information, you will be unable to use our service, or access certain services, offers and content on our website.

In addition to collecting information about children from parents or legal guardians, we may also collect information about parents, legal guardians, and/or children from schools or related entities. For example, if a school wants to help parents and guardians establish carpools, they may provide us with information to create accounts for those parents and guardians. Please note that the use of your personal information by a third party, such as a school, is subject to any agreements that you have in place with that third party. Information we collect automatically through your use of our [Services]: CarpooltoSchool may also collect certain information from visitors to and Schools of the Site, such as Internet addresses, browser type, domain name, access dates and times, referring website, page views, and device identification information.

Providing and maintaining our [Services]. We use the information you provide us to provide the CarpooltoSchool services. Specifically, we will use your contact information to send you email and text messages with notifications and reminders of carpool schedules and to provide you with updates to the schedule. We will also provide to persons/families that you have selected to be a part of your carpool group your contact information, information about the time, date, and location of the relevant events and special instructions regarding your child(ren). SUBJECT TO THE LIMITATIONS SET FORTH IN THE LAST PARAGRAPH OF THIS ‘HOW WE USE YOUR INFORMATION’ SECTION, IN NO EVENT WILL YOUR CHILD(REN)’S SCHEDULE, PICK UP LOCATION, DROP OFF LOCATION, NAME OR SPECIAL INSTRUCTIONS BE SHARED WITH ANY INDIVIDUALS OUTSIDE OF THE OTHER USERS WITH WHOM YOU HAVE SPECIFICALLY MADE CARPOOL ARRANGEMENTS.

Marketing and communications. From time to time, we may use your information to contact you via e-mail, regular mail, or telephone to determine whether you are happy with our services and/or send you School satisfaction surveys. We may also contact you to advise you of offers or promotions your school has approved. When you first sign up to participate in CarpooltoSchool, you have the option of not to receive these communications by clicking on the indicated box in the sign-up process. Further, after you have signed up, you retain the ability to “opt out” of such communications by editing your profile and clicking on the indicated box. (You will not be able to opt out, however, of viewing sponsor information that may appear on our website and Mobile App and in the email and text message reminders relating to your carpooling arrangements.) For instructions regarding editing your information, please refer to “Editing, Updating, Correcting and Deleting Your Information” below.

Protecting rights and interests. We will use your information in order to protect the safety, rights, property, or security of CarpooltoSchool, our [Services], any third party, or the general public; to detect, prevent, or otherwise address fraud, security, or technical issues; to prevent or stop activity which we may consider to be, or to pose a risk of being, an illegal, unethical, or legally actionable activity; to use as evidence in litigation; and to enforce this Privacy Statement or our Terms of Use.

Legal compliance. We may use your information in order to comply with applicable legal or regulatory obligations, including as evidence in litigation or in response to a court order, subpoena, warrant, or other request from law enforcement or a governmental authority.

Research and analytics. We may use your information to create aggregated and anonymized information, such as aggregate information about the demographics or locations of our users broadly. We use such information to analyze how you interact with our [Services] and to improve our [Services]; to monitor and analyze usage and activity trends; and for other research, analytical, and statistical purposes.

CarpooltoSchool users. In order to effectively provide our Services, we may share your information with other CarpooltoSchool users, such as parents, legal guardians, or schools. For example, if you set up a Carpool arrangement with another parent, then we will share information about you and your child(ren) with that parent. By accepting use of our [Services], you expressly understand and agree that CarpooltoSchool may provide information about your child(ren) to either parent of the child(ren) (and/or legal guardians of the child(ren) as the case may be), provided that such parents or legal guardian is a user of our [Services], regardless of the relationship or custody arrangements between the parents and CarpooltoSchool expressly disclaims disclosure of information to such sources.

Affiliates. We may disclose your information to current or future affiliates or subsidiaries for research, marketing, or other purposes consistent with this Privacy Statement.

Service providers. We may disclose your information to our vendors, service providers, agents, or others who perform functions on our behalf. For example, we may disclose your information to third-party service providers to store our information or help us send emails.

Business transfers. In the event of a sale of our business or any assets, we will disclose your personal information to a purchaser as part of that transaction, including during negotiations or planning of such a transaction.

Legal compliance and protecting rights and interests. We reserve the right to disclose your personal information where required by law, in response to legal process and law enforcement requests and/or when, in our sole discretion, it is necessary to protect your/your child(ren)’s safety and interests or the interests of CarpooltoSchool and/or its affiliates. In addition, please be advised that, in an emergency situation that may affect the health or safety of a child, CarpooltoSchool, may, in its sole discretion, disclose personal information about you or your child(ren) to appropriate sources. In such an emergency situation, CarpooltoSchool will attempt to contact you first before disclosing such information but if such attempt is unsuccessful, you understand and agree that CarpooltoSchool may disclose such information and shall not be liable for such disclosure.

With your consent. We may disclose your information to other third parties if you provided us with your consent to do so.

Aggregate and de-identified information. We may disclose aggregate, anonymous, or de-identified information about users for marketing, advertising, research, compliance, or other purposes.

To edit, update or correct your information, simply click on “edit my settings” on the website and Mobile App and make the required changes. If you need additional support, please email custserv@CarpooltoSchool. Please note that any requests to remove or update your personal information through our email support may take up to five days and we may retain certain information about you as required by law or as permitted by law for legitimate business purposes. For example, if you request that we delete your information but we believe that you have violated our Terms of Use we may retain information about you in order to attempt to resolve the issue before deleting it. Once you have deleted or removed your account from CarpooltoSchool, all personal information will be permanently deleted.

We take special care to protect the safety and privacy of children. Our [Services]are general audience. We do not knowingly permit anyone under the age of 16 to register with us unless. We also do not send email correspondence to anyone who tells us that they are under the age of 13 without their parent’s consent. We urge parents and guardians to participate in their children’s online activities and use parental control or other web filtering technology to supervise children’s access to the web.

We and our service providers use cookies and other tracking mechanisms to track information about your use of our [Services]. We or our service providers may combine this information with other information, including personal information, we collect about you.

Cookies. A cookie is a small amount of data that is sent to your browser from a web server and stored on your computer’s hard drive. Generally, we use cookies to remind us of who you are, tailor our services to suit your personal interests, estimate our audience size, track use of our [Services]and to process your registration, and track success of our promotions. You can generally set your browser to not accept cookies or to notify you when you are sent a cookie, giving you the chance to decide whether or not to accept it. If you choose not to accept the cookie, we may not be able to track your registration. Nor will we be able to recognize you as a signed up user to allow you access to your account information.

Clear GIFs, pixel tags, and other technologies. Clear GIFs are tiny graphics with a unique identifier, similar in function to cookies. In contrast to cookies, which are stored on your computer’s hard drive, clear GIFs are embedded invisibly on web pages. We may use clear GIFs (also referred to as web beacons, web bugs, or pixel tags) in connection with our [Services] to, among other things, track the activities users of our [Services], help us manage content, and compile statistics about usage of our [Services]. We and our third party service providers also use clear GIFs in HTML emails to our customers, to help us track email response rates, identify when our emails are viewed, and track whether our emails are forwarded.

Third-party analytics. We may use third-party analytics companies to evaluate use of our [Services]. We or our service providers use these tools to help us understand use of, and to improve, our [Services], performance, and user experiences. These entities may use cookies and other tracking technologies, such as web beacons or local storage objects (LSOs), to perform their services. Such analytics companies include Google Analytics. Do Not Track Disclosure. Currently, our [Services] do not recognize browser “do-not-track” requests. You may, however, disable certain tracking as discussed in this Cookies and Tracking section (e.g., by disabling cookies). You also may opt out of interest-based advertising by following the instructions in the Interest-Based Advertising section below.

Our [Services] may contain links to websites, applications, or other services operated and maintained by third parties, over which we have no control. Privacy policies on such linked services may be different from this Privacy Statement. You access such third-party services at your own risk. You should always read the privacy policy of any third-party service before disclosing any personal information to the third party.

We take precautions, including use of encryption and authentication tools, to protect the security of your personal information that you share with us. Despite these security measures, no data transmission over the Internet can be guaranteed to be 100% secure. As a result, while we strive to protect your personal information, we cannot guarantee or warrant the security of any information you transmit to or from our website, and you do so at your own risk. Therefore, we cannot be and are not responsible for unauthorized access to your information that is the result of hackers or others who have obtained access through illegal measures, hardware or software failures, acts of God or any other factors that compromise the security of the data we collect. We urge you to keep your password in a safe place and not to divulge it to anyone. Also remember to log off your account and close your browser window when you have finished your visit to ensure that others cannot access your account.
